এক অন্তর্বর্তীকালীন আদেশে এ কথা
জানিয়েছেন। এই বিষয়ে রাজ্য
সরকারকে 6-সপ্তাহের মধ্যে
হলফনামা দাখিল করার জন্য
তিনি নির্দেশ দিয়েছেন বলে আইনজীবী এক্রামুল
বারি জানান। SSC কেও এই বিষয়ে
হলফনামা দিতে হবে. 8-সপ্তাহ পার এই Court Case -এর চূড়ান্ত শুনানির
জন্য তালিকাভুক্ত করা হবে। গত
বছর SSC-র
প্রধান শিক্ষক শিক্ষিকা নিয়োগের
আইনের বৈধতা নিয়ে বেশ
কয়েকজন উচ্চ আদালতে যান।সুভাষগ্রাম
গৌরীসুন্দরী বালিকা বিদ্যালয়ের শিক্ষিকা
মৌসুমি রক্ষিত সহ কয়েকজন
এই বিষয়ে আদালতে দরবার
করেন। তাদের বক্তব্য ছিল,
নয়া আইন সংবিধান বিরোধী
ও একপেশে। সেখানে স্নাতকোত্তর ডিগ্রিধারীদের 50% Number / Marks না থাকলে
প্রধান শিক্ষক শিক্ষিকাপদে বসা
যাবে না বলে জানানো
হয়। মামলাকারীদের পক্ষে আইনজীবী এক্রামুল
বারি জানান, লিখিত পরীক্ষায়
সফল হলেও ইন্টারভিউ-এ 50% কম Number / Marks
থাকায় SSC কর্তৃপক্ষ তাদের
ডাকা হবে না বলে
জানায়। বিচারপতি শেখর বি শরাফের
নির্দেশানুযায়ী, SSC-র
এই নির্দেশ আপাতত কার্যকর করা
যাবে না.

হল, ইংরেজি মাধ্যমে কোনও
বিদ্যালয়ে শিক্ষকতা করলে এই বছরগুলির
অভিজ্ঞতা বাদ দেওয়া যাবে
না। আইনজীবী এক্রামুল বারি জানান, হলদিয়ার
মঙ্গল কুমার ভৌমিকের আবেদনক্রমে
বিচারপতির নির্দেশ, মধ্যশিক্ষা পর্ষদ বা উচ্চমাধ্যমিকশিক্ষা পর্ষদের অনুমোদিত নয় এমন কোনো
বিদ্যালয়ে কাজ করলেও সেই
কয়েক বছরের অভিজ্ঞাত ধরে
শিক্ষক শিক্ষিকাদের ইন্টারভিউ-এর সুযোগ দিতে
হবে। এই ক্ষেত্রে SSC-র সিদ্ধান্ত কার্যকর
হবে না বলে বারি
সাহেব জানান।

The application rules pertaining to eligibility for the post of Headmaster/ Headmistress in 2012 was that the candidate was required to have secured at least 40% Marks in Post Graduate Examination and the candidate was required to have at least ten years experience as teacher. New Rules were introduced regarding eligibility for the post of Headmaster / Headmistress in March 2015 where under the experience of ten years remained unchanged as also the 40% Marks remained unchanged. In September 2016, further fresh Rules were introduced whereunder the required teaching experience remained ten years but the required Marks were enhanced from 40% to 45% in the Post Graduate Examination. Again, in March 2017 the Rules were amended and the required Marks was enhanced to 50%.
The Petitioners contend that they became eligible for the post of Headmaster/ Headmistress prior to the amendment of 2017. Had the examination for appointment to the post of Headmaster / Headmistress been held prior to the amendment of 2017, they would have been entitled to participate in the examination since the requisite marks under the old Rules was 45 per cent. They submit that the 2017 amendment is wholly unreasonable and arbitrary and cannot affect the vested right that has accrued in their favour. They have challenged the vires of the 2017 Amendment.
I have also hereby the learned Government Pleader for the State. I cannot possibly disagree with his submission that fixing the eligibility criteria for recruiting teachers is within the exclusive domain of the administration and the Court shall not easily interfere. After all, the quality of the education to be imparted would depend on the quality of the teaching staff and it is in the interest of everybody concerned that the quality of the teaching staff is of a minimum standard.
However, if certain amendments are made arbitrarily and unreasonably, the Court has the power to strike down the same. On this point, the learned Government Pleader does not join issue. However, this question has to be gone into at the final hearing of the writ petition.
By way of an interim measure, since the last date for applying online is today i.e. 7th July, 2017, without prejudice to the rights and contentions of the parties, I permit the petitioners to apply offline since their application may not be accepted online. The respondent nos 3 and 4 are directed to accept such application of the petitioners if made on or before 10th July 2017. However, the petitioners shall not sit the examination without the leave of this Court. The petitioners shall also deposit the requisite Court fees in course of today i.e. 7th July, 2017.
Let Affidavit-in-opposition be filed within a fortnight from date. Reply, if may be filed within a week thereafter.
List the matter before the appropriate Bench three weeks hence.
This order shall not be treated as a precedent and shall not create any equity in favour of the petitioners.
Let a plain copy this order, duly countersigned by the Assistant Registrar (Court), be handed over to the learned advocate-on-record for the petitioner on usual undertaking.
