Gazette of Pass-Fail for fifth and eight class in Government Schools, the Right of Children to Free and Compulsory Education Act 2019 & West Bengal Right of Children to Free and Compulsory Education Rules 2012, Amendment of Pass-Fail, the President approved the Pass-Fail System for fifth and eight class in West Bengal.

In exercise of the power conferred by sub-section (1) of section (ধারা) 38 read with the clause (fa) of sub-section (2) section (ধারা) 38 of the Right of Children to Free and Compulsory Education Act, 2009 (35 of 2009), the Governor (গভর্নর) is pleased hereby to make the following amendments (সংশোধন) in the West Bengal Right of Children to Free and Compulsory Education Rules, 2012 as published in Kolkata Gazette Extraordinary, Part-I dated the 16th March, 2012 (hereinafter referred as the said rules) with effect from 1st January, 2020.

Amendment of Pass-Fail 

In the said rules, after rule (বিধি) 8, the following rule shall be inserted-

"8A. Provision (বিধান) relating to held back of child (শিশু) under sub-section (উপধারা) (3) of section (ধারা) 16 of the Act (আইন).- 

(1) There shall be as assessment based on the total score obtained in the three Summative Evaluation of Continuous Comprehensive Evaluation in the fifth class and in the eight class of every academic year.

(2) If a child (শিশু) fails (ফেল) in the assessment (মূল্যায়ন) referred in sub-rule (1), he shall be given enough support by the school authority (স্কুল কর্তৃপক্ষ) in the form of "Special Teaching" and additional (অতিরিক্ত) support as deemed necessary (প্রয়জনীয়) by the school authority (স্কুল কর্তৃপক্ষ) to bring the child at the desired level and opportunity be given for re-assessment in the manner as may be not notified, within a period of two months (দুই-মাস)from the date of declaration (ঘোষণা) of the result of the assessment referred above.

Note: The School Authority shall identify students who have lagged behind the desired level of learning ability in the first two Summative Evaluation of Continuous Comprehensive Evaluation and shall arrange special support for them that time period without waiting for the outcome of final Assessment mentioned in the sub-rule(1).

(3) A Child (শিশু), who will fail in re-assessment, shall be held back for one academic year (শিক্ষাবর্ষ) in the same class.

(4) No Child shall be expelled from a school till the completion of elementary education (প্রাথমিক শিক্ষা)".

An Act further to amend the Right of Children to Free and Compulsory Education (বাধ্যতামূলক শিক্ষা) Act, 2009

BE it enacted by Parliament in the Sixty-ninth (69th)Year of the Republic (প্রজাতন্ত্র) of India as follows-

1. (1) This Act may be called the Right of Children to Free and Compulsory Education (Amendment) Act, 2009.

(2) It shall come into force (কার্যকর করা) on such date as the Central Government (কেন্দ্রীয় সরকার) may by notification in the Official Gazette (সরকারী গেজেটে), appoint.

2. In the Right of Children (শিশুদের অধিকার) to Free and Compulsory Education (বাধ্যতামূলক শিক্ষা) Act, 2009 (hereinafter referred to as the principal Act), for section 16, the following section shall be substituted, namely-

"16. (1) There shall be a regular (নিয়মিত) examination (পরীক্ষা) in the (পঞ্চম শ্রেণী) fifth class and in the (অষ্টম শ্রেণী) eight class  at the end of (শিক্ষাবর্ষ) every academic year.

(2) If a child fails in the examination (পরীক্ষা) referred to in sub-section (1), he shall be given additional (অতিরিক্ত) instruction and granted opportunity (সুযোগ) for re-examination within a period of two months from the date of declaration (ঘোষণা) of the result.

(3) The appropriate Government (সরকার) may allow schools to hold back a child in the (পঞ্চম শ্রেণী)fifth class or in the eight class (অষ্টম শ্রেণী) or in both classes, in such manner and subject to such condition as may be prescribed, if he fails in the re-examination referred to in sub-section (2):

Provided that the appropriate Government (সরকার) may decide not to hold back a child in any class till the completion of (প্রাথমিক শিক্ষা) elementary education .


(4) No child shall be expelled from a school till the completion of elementary education (প্রাথমিক শিক্ষা)".

3. In section (ধারা) 38 of the principal Act, in sub-section (2), after clause (f), the following clause shall be inserted, namely-

"(fa) the manner (পদ্ধতি) and the conditions (শর্ত) subject (বিষয়) to which a child (শিশু) may be held back under sub-section (3) of section (ধারা) 16"

Pass-Fail is returning to Govt. Schools in fifth and eighth class

ফের চালু হচ্ছে Pass-Fail System ৷ Fifth ও Eight class এ ফিরছে Pass-Fail৷ আগামী শিক্ষাবর্ষ অর্থাৎ জানুয়ারি মাস থেকে সরকারি স্কুলগুলিতে শুরু হবে Pass-Fail৷ রাজ্যে Fifth ও Eight class-তে Pass-Fail এর এই পদ্ধতি  আরাম্ভ করার অনুমোদন দিল রাজ্য সরকার৷

আগেই Eight class পর্যন্ত Pass-Fail ফিরিয়ে আনার সিদ্ধান্ত নিয়েছিল কেন্দ্র৷এই বিষয়ে রাজ্যগুলির সম্মতি চেয়েছিল কেন্দ্রীয় মানব উন্নয়ন মন্ত্রক ৷ Eight class পর্যন্ত  Pass-Fail প্রক্রিয়া ফিরিয়ে আনার পক্ষেই নিজের মত জানিয়ে কেন্দ্রকে চিঠি দিয়েছিল রাজ্য৷ কেন্দ্র Sixth ও Eight class তে Pass-Fail ফেরানোর প্রস্তাব দিলেও, রাজ্য চাইছিল Fifth থেকে Eight class এর  যে কোনও একটি class এ চালু হোক এই প্রথা। তবে শেষ পর্যন্ত Fifth ও Eight class এ  শুরু হবে Pass-Fail৷

Fifth ও Eight class এর বার্ষিক পরীক্ষায় কোন ছাত্র/ছাত্রী উর্ত্তীণ না হলে সেই শিক্ষাবর্ষের বার্ষিক পরীক্ষার ফলাফল প্রকাশের 2-মাসে মধ্যে উক্ত পরীক্ষার্থীর পুনরায় পরীক্ষা নেওয়ার ব্যবস্থা করতে হবে,তারপরও পরীক্ষার্থী উর্ত্তীণ না হতে পারলে স্কুল তাকে একই class এ রেখে দিতে পারবে।

If State wants, it can return to Pass-Fail system, with approval of President

স্কুলস্তরে ‘Pass-Fail’ System ফের ফিরছে। সংসদে এ বিষয়ে সংশ্লিষ্ট আইন সংশোধন হওয়ার পর রাষ্ট্রপতির সম্মতি মিলেছে। সেইমতো চলতি বছর থেকেই বিদ্যালয় স্তরে Fifth এবং Eight class তে রাজ্যগুলি চাইলে স্কুলে Pass-Fail System চালু করতে পারবে। রাইট অব চিলড্রেন টু ফ্রি অ্যান্ড কম্পালসারি এডুকেশন (শিক্ষার অধিকার) আইন অনুযায়ী এতদিন Eight class পর্যন্ত Pass-Fail System ছিল না।

এতে দেশের সকল শিশুকে স্কুল স্তরে শিক্ষাদানের উদ্যোগ নেওয়া হলেও আদতে Pass-Fail System না থাকায় পড়ুয়াদের শিক্ষার মান পড়ে গিয়েছে বলেই কেন্দ্রীয় মানবসম্পদ উন্নয়নমন্ত্রী প্রকাশ জাভরেকরের মত। তাই রাজ্যগুলির সঙ্গে আলোচনা করেই, তার মাধ্যমেই শিক্ষার অধিকার আইনে সংশোধন করা হয়। সদ্য সমাপ্ত সংসদের শীতকালীন অধিবেশনে লোকসভা এবং রাজ্যসভায় ওই সংশোধনী বিল পাস হয়েছে। রাষ্ট্রপতি রামনাথ কোবিন্দের সম্মতির পর তা কার্যকরও হল। নতুন আইন অনুযায়ী, Fifth এবং Eight class তে এবার থেকে ছাত্রছাত্রীদের ‘Pass-Fail’র পরীক্ষায় বসতে হবে। তবে যারা উত্তীর্ণ হবে না, তাদের জন্য ফের একবার করে পরীক্ষায় বসার সুযোগ দেওয়া হবে। সেটিতেও পাস না করলে পুরনো class-ই থাকতে হবে।
