Order for non-disbursement of Salary of defaulting Teachers from the month of April 2019, these Teachers of Higher Secondary Schools / High Schools/ Junior High Schools/ Madrasah/Junior Madrasah were not attend training or election duty in connection with the General Election to Lok Sabha 2019.

Non-disbursement of Salary to defaulting Teachers in General Election 2019

This is to inform you that appointment for training in connection with the General Election to the Lok Sabha 2019, has been generated in pursuance of section 26th of the Representation of the People Act 1951 and duly issued to below listed teacher of respective Higher Secondary Schools / High Schools/ Junior High Schools/ Madrasah/Junior Madrasah for training on 23.03.2019 and 24/03.2019 respectively. A large number of teachers of the above mentioned institutions listed below were absent in the training.
Thereafter mop-up training on 27.03.2019 was conducted after the service of show cause letter, now it has been observed after given sufficient opportunity to attend the election training, the following teachers as listed (in the attachment) not attended the training duly till date.
You may be aware, as per the latest order bearing No 1295-Home(Elec)/R3E-35/2019 dt 12.03.2019 of the Chief Secretary to the Government of West Bengal, Home & Hill Affairs Department, Election Branch and No 1296-Home(Elec)/R3E-35/2019 dt 12.03.2019 of the Chief Electoral Officer, West Bengal, all the employees under your control should attend election duty without fail.
Under the above circumstances, you are instructed to ensure the following -
(1) Initiation of Department Proceedings to all such defaulting teachers and arrangement of entry of dereliction of election duty in their respective service records (Books).
(2) Issue necessary order for non-disbursement of Salary of these defaulting teachers from the month of April 2019.
(3) To initiate appropriate penal actions for beach of election duty as per the Acts and Provisions of the Representation of the People Act 1951, Section 28A, Section 134, Section 159(I) & (II) and Section 174 of Indian Penal Code (IPC) 1860.
Lastly you are instructed to issue immediate necessary order for compliance of above instructions or else appropriate penal actions will be initiated against you.

As directed by the Authority, all teachers (Primary and Secondary) who failed to perform Polling personnel duty but got honorarium through Bank Account are directed to refund honorarium at the Nazir Section of the office of the undersigned in cash within one week from the receipt of this letter by ADI or SI.
You are requested to apprise these teachers of this matter and other wise Election Commission may take necessary action as per provision of Election rules.

Sir,
I am directed to state that in modification of the order referred to above the Para-teachers shall be eligible to contest in Panchayat General Elections in terms of Section 7(b) of the West Bengal Panchayat Elections Act 2003 as they are in service of educational institutions, subject to conditions laid down by the School Education Department, Government of West Bengal vide their No. 334-SE/EE/10M-255/17 dated 06.04.2018 (Copy enclosed)
