Direction/Order for not taking any step towards illegal approval of appointments in violation of Solemn order of Hon'ble Supreme Court dated 17.05.2018 and 21.08.2018 in connection with SLP(C) 6661 of 2016, Sk Md Rafique Vs MC Contai Rahamania High Madrasah & ors.

In reference to the subject mentioned above, of late it has come to the knowledge of this office and the MA&ME department that some unlawful and fraudulent activities are going on relating to appointments of teaching and non-teaching staffs in various Government Aided Madrasahs in gross violation of  Law and absolute violation of the Solemn Order passed in connection with the case as mentioned earlier in the subject above.

Recently some Madrasahs / Managing Committees have published illegal advertisement for conducting written test/interview for recruitment of teaching and non-teaching staff in their Madrasahs, and not only that, they are trying to give approval of appointment to ineligible/unqualified /under qualified candidates in respective Madrasahs, which is breach of existing Law(s) and Order(s) of the State Government / Hon'ble Supreme Court of India. Some have already appointed teaching /non-teaching in gross violation of all norms /rules /orders.

In this connection he/she is directed not to give approval of appointment to any teaching or non-teaching staffs of Aided Madrasahs here such appointments have been made by the Managing Committees without the recommendation of Madrasah Service Commission or without any specific mandatory order of any court of Law (Hon'ble Supreme Court of India/Hon'ble High Court, Calcutta).

It has also been noticed that papers submitted related to such appointments by managing committees are being submitted in the office of concerned DI/ADI office two to three years of appointments which clearly suggests that the appointment have been made on ,manufactured papers, backdated and with a malafide intention.

In view of the above the concerned DI/ADI is directed hereby to give every intimation of acts relating to this subject, to the office of this Directorate and to send all papers/ documents/testimonials to this office which has already been submitted in their concerned office earlier as after given appointments.

Any act avoiding the direction made above will be viewed strictly and higher authorities in the State Government, will be informed accordingly to take cognizance of the matter.
