Regarding involvement of Teacher in Private Tuition

The undersigned has to request all the HOIs regarding reply to RTI application to intimate this office within 15 days that where any complain has been lodged against any teacher of your school for being involved in Private Tuition. You are also requested to intimate whether any teacher of your school is involved in Private Tuition. It should be noted that in terms of (notice) Notification No. 214-SE/S/10M-01/18 dated Kolkata 08.11.2020 (Appointment, confirmation conduct & discipline of Teacher and Non-teaching staff) Roles 2018, Private Tuition has been prohibited strictly for school teachers (copy enclosed). Reply must be sent to the email of the countersinged undersigned with a copy of the Sub-Division.

Notification regarding Private Tuition

Subject : Submission of action taken report regarding non-involvement of the teachers in Private Tuition for personal gain.

Ref: Communicated to all concerned institutions by e-mail under 
1. Memo No. 04/H  dated 07.01.2020 of this office.
2. Memo No. 202/H dated 20.02.2020 of this office in connection with RTI (issued to 32 Schools)

With reference to the subject mentioned under reference above, the undersigned has to inform the concerned all as per Section 28 of the Right to Education Act, 2009 and as per rule 4(6) of notification No. 214-SE/S/10M-01/18 dated 08.03.2018, no teacher shall engage himself /herself in any sort of Private Tuition for personal gain and accordingly this office has issued letter vide No. 04/H dated 07.01.2020 to submit an action taken report but it appears that maximum number of schools did not submitted the same.

So, after taking that declaration a certificate has to be submitted stating like "Certified that declaration from all teaching staff have been received in connection with their non-involvement in Private Tuition and so salary requisition is prepared and submitted." The aforesaid certificate (by e-mail and in hardcopy) has to be submitted at earliest by this month positively, failing which the competent authority will be intimated to take necessary action.

His/her cooperation and prompt compliance to submit the action taken report regarding the issue is anticipated.

Complaint against the teacher engaged in Private Tuition

(i) Memo No. 289(3)/EDU dated 08.10.2020 of office of the District Magistrate and Collector Birbhum
(ii) Letter received from Sr. Consultant, NCPCR vide No. 157609/2020-21/RTE-202280.

In reference to the above mentioned subject the undersigned has to inform him/her that a serious complaint has received so far from Sr. Consultant of NCPCR duly forwarded by District Magistrate, Birbhum ageist a large number of teachers ( copy enclosed) with clearly reflects that they are involved in Private Tuition.

In terms of section 28 of The Right of Children for free and compulsory Education act-2009 as well as West Bengal Board of Secondary Education (appointment, confirmation, conduct and discipline of teachers and non-teaching staffs) Rules 2018 vide GO No. 214-SE/S/10M-01/18 dated 08.03.2018 under clause 4(6), no teachers shall engage himself/herself in any sorts of Private Tuition.

It is unfortunate that the alleged teachers have been warned several times from this office memo No. 1840/G dated 23.07.2019, 54/G dated 08.01.2020 and 382/G dated 03.02.2020 but it seems that they are not prevented themselves from such illegal practice and believing that system cannot take any disciplinary action against them. It is highly irregular and sheer violation of Government Rules.

Considering the gravity of the matter he/she is requested to take stem steps against the teacher engaged in Private Tuition in terms of Code of conduct and discipline of teachers or non-teaching staff of the institution.

It is noteworthy to mention that the investigation process will continue and any teachers found to be involved in Private Tuition, the matter will be brought to the notice of NCPCR forthwith, Besides, an arrangement of personal hearing maintaining COVID-2019 guideline will be made shortly in Sub-Division office to resolved the issue.

The matter should be treated as extremely urgent.

As per above reference of School Education Department WB & District Magistrate, Purba Medinipur, all Sub-Inspector of Schools are hereby requested to collect Self-Declaration from each Primary School Teacher under their Jurisdiction as "they are not engaged any Private Tuition or any other business except Teaching Profession in respective Schools" so that code of conduct that mentioned in Rule 4(6) is followed by all the teaching and non-teaching staff.
