1. The Hon'ble Supreme Court's order dated 03.04.2025 passed in the above Special Leave Petition.
2. The Hon'ble Supreme Court's order dated 17.04.2025 passed in the above Miscellaneous Application.

In reference to the above, I would like to inform you the following:
1. The Hon'ble Supreme Court was pleased to dispose of the aforesaid (SLP) Special Leave Petition (Civil) No. 9586 of 2024 along with other analogous matter on 03.04.2025.

2. Thereafter, the aforesaid Miscellaneous Application No.709 of 2025 has been disposed of by the Hon'ble Supreme Court on 17.04.2025 when the Hon'ble Supreme Court has granted permission for the Assistant Teachers, who were appointed for Classes IX and X and Classes XI and XII under the respective selection process of SLST 2016 and who have not specifically been found to be tainted, to continue their services in the schools till the completion of the recruitment process by 31.12.2025 subject to the conditions as stipulated in the solemn order dated 17.04.2025.

The West Bengal School Service Commission has sent the lists of the Assistant Teachers, who were appointed for Classes IX and X and Classes XI and XII under the respective selection process of SLST 2016 and who have not specifically been found to be tainted vide their e-mail dated 22.04.2025. The lists are forwarded for taking necessary action.

Copied of the Hon'ble Supreme Court's order dated 03.04.2025 and order dated 17.04.2025 are also sent herewith for your perusal and taking necessary action.

This is urgent.

সকল বিদ্যালয়ের HOI-দের জানানো হচ্ছে যে
1. 1st SLST 2016 শিক্ষক/শিক্ষিকাদের মধ্যে যাদের নাম 'Not found to be specifically tainted list-এ নেই তাদের Salary Stop হবে।

2. 3rd RLST 'Group-C' and 'Group-D' employee দের Salary Stop হবে।

3. উল্লেখিত সব ক্ষেত্রে যারা PH Category তাদের Salary হবে।

4. যে সব Teacher আপনার বিদ্যালয়ে Transfer IN হয়েছেন, তারা যে জেলা থেকে এসেছেন সেই জেলার 'Not found to be specifically tainted' list-এ নাম থাকলে Salary পাবেন, নাম না থাকলে Salary পাবেন না।

5. উপরিউক্ত বিষয়গুলি বিবেচনা করে, যাদের Salary Stop হতে চায়, অফিস থেকে তাদের "STOP SALARY'' করা হয়েছে। এক্ষেত্রে (Stop Salary/ Start Salary)যারা সময়ে Google Form Reply করেননি, দরকার হলে তাদের অবিলম্বে অফিসে এসে যোগাযোগ করতে হবে।

6. আপনারা Salary Finalize করার সময় ভালো করে Check করে নেবেন, যাদের Salary পাওয়ার কথা তারা পেলেন কিনা এবং যাদের Salary Stop হওয়ার কথা তাদের Salary Stop হলো কিনা।

7. Salary Finalize করার আগে PF Check করে নেবেন।

8. যদি কোনো ভুল থাকে, অফিসে অবিলম্বে যোগাযোগ করতে হবে।

of the Dept. of Labour, Government of West Bengal

Sir/Madam,
Enclosed please find herewith Kolkata Gazette Notification vide No. Labr-58/2025/(LC-LW/MW) dated 15th May 2025 of the Department of Labour, Government of West Bengal containing the West Bengal Livelihood and Social Security Interim Scheme 2025. You are requested to take up the following procedure for smooth implementation of the said Scheme referred therein above.

Process flow to ensure only eligible applications are received, cross checked 
and forwarded to the Labour Department:

a. The referred notification has already been made available in the Banglar Shiksha Portal, for wide circulation. You are directed to forward the said notification to the Head of the Institutions (HOI) of the Schools having such Group-C and Group-D employees whose appointments have been set aside consequent upon the judgment and order dated 3rd April 2025 passed in Civil Appeal No.4800 of 2025 (Same of West Bengal Vs Baisakhi Bhattacharyya & Ors.)

 b. The concerned Group-C and Group-D employees whose names were reflected in the payroll of the Department and its Directorate or Board, against a permanent vacancy at the time of pronouncement of the said order and whose appointments have been set aside may submit an application by filling the requisite details in the forms prescribed in Annexure-A to the said notification to the Head of the Institution (HOI) of the concerned schools for verification.  

c. Upon receiving the said applications from the Group-C or Group-D employees, the Head of the Institutions (HOIs) will ensure that he has gone through the said notification both in letter and spirit. They must verify the eligibility of the applicants based on school records and upon being fully satisfied, forward the verified applications to the concerned DI/s (SE).

 d. Your office upon receiving the applications duly verified by the Head of the Institution (HOI) will cross verify all the information contained in the said application with the record in iOSMS Portal and certify the eligibility of the applicant with respect to the said notification and send all such eligible applications to the School Education Directorate.

           On receipt of the verified applications, the School Education Directorate will compile the same, cross check with the data available in the iOSMS Portal and forward them to Labour Commissioner in compliance of the said Scheme.

The order issues with the approval of competent authority.

Submission of Service Particulars under SLST and RLST 2016

Request for submission of Service particulars/departments of the teachers of IX-X and XI-XII appointed through the 1st SLST 2016 as well as the Group-C and Group-D staff appointed through the 3rd RLST 2016

Ref: 1.Order dated 03.04.2025 passed by Hon'ble Supreme Court in Civil Appeal arising out of Special Leave Petition (Civil) No. 9586 of 2024 (Baishakhi Bhattacharyya (Chatterjee) and Others Versus The State of West Bengal) and other analogous matters

2. Order dated 17.04.2025 of the Hon'ble Supreme Court in Miscellaneous Application No.709 of 2025 in Civil Appeal No.4805 of 2025.


          In reference to the above you are requested to submit the following reports along with attested photocopies of particulars/ documents as noted below in respect of the existing teachers of IX-X and XI-XII appointed through the 1st SLST 2016 as well as the existing Group-C and Group-D staff appointed through the 3rd RLST 2016 as on 1st April 2025.

1. A Consolidated Report (in enclosed Format-A) along with attested photocopies of -
            (i) Recommendation letter issued by CSSC/RSSC.
            (ii)Appointment Letter issued by WBBSE.
           (iii) Joining report of the teacher/non-teaching staff
           (iv) Approval Memo

           In case where the teacher/non-teaching staff (appointed through 1st SLST 2016/ through 3rd RLST 2016) joined the present school on transfer attested photocopies of (i) recommendation letter for transfer (ii) transfer order issued by the competent authority (iii) approval memo issued from this office are also to be submitted from your end.

2. A report (in enclosed Format B) mentioning particulars of Teachers/Non-teaching Staff who was/were initially appointed in your school but not joined or after joining subsequently transferred/resigned /died-in-harness, Supporting documents such as attested copies of first recommendation letter, appointment letter, approval memo, non-joining report, recommendation and order of transfer, release order, resignation letter and its acceptance, death certificate etc. are also to be annexed with filled up Format-B.

             Consolidated Reports with required documents as stated above is to be submitted to the office of the undersigned by 25.04.2025 positively.

              Schools having no employee appointed through the 1st SLST 2016 and /or 3rd RLST 2016 will also have to submit 

             Consolidated Reports mentioning "Nil" in respective column and certificate of the report.

            After receipt of reports from schools, necessary exercise will be done from this end. Schools will be informed accordingly for submission of salary bill for staff for the month of April 2025 after completion of the said exercise.
                The matter is to be treated as urgent.
