The order published under this office memo no. 56-SE(B)/5B-1/2009 dated 2nd April, 2009 in continuation of Department's Memorandum No. 46-SE(B) dated 27.02.2009 regarding Revision of Pay and Allowances, 2009 for West Bengal Non-Government Aided Educational Institutions Employees fail short on clarifying many issues raised from different quarters including Teacher's Association. Similarly Finance Department in its Memorandum No. 2014-F dated 9th March, 2009 and Memorandum No. 2728-F dated 07.04.2009 has also clarified different issues which need to be incorporated in the clarificatory memorandum.
In cancellation of the Memorandum no. 56-SE(B) dated 2nd April, 2009, the following comprehensive memorandum is published dealing with the issues involving the application of ROPA, 2009 in respect of West Bengal Non-Government Educational Institutions Employees are mentioned in Annexure-I of Memorandum no 46-SE(B) dated 27.02.2009.
1. Existing benefit after completion of 18 years of continuous service
An employee whose pay is fixed in any of the revised pay structure up to Pay Band 3 in the Annexure-VI and who has not got a single promotion/ advancement to a higher scale in the same post even after completion of 18 years continuous and satisfactory service shall be placed in the next higher grade pay of the same pay band or lowest grade of the next higher pay band, as the case may be with the approval of the concerned District Inspector of Schools, the designation of the employee remaining unchanged.

আগের মতো ROPA-2019 তেও 18 years এর ক্ষেত্রে Additional Increment এর পৃথক কোনো Scale নেই। Vide G.O. No. 437-SE(P&B)/SL/5S-408/19 dated 13.12.2019 ( নিম্নে Memorandum টি দেওয়া হলো )

In view of the recommendations of the 6th Pay Commission constituted vide Resolution No. 8070-F(P) dated 27.11.2015 read with Resolution No. 8071-F(P) dated 27.11.2015 accepted by the Government, the Government has been pleased to directed that the date of effect of the revised pay structure, the manner of fixation of pay in the revised pay structure and other conditions of service of the employees mentioned in para 2 below are set out in the following other paragraphs.
3. Fixation of pay of the employee after obtaining non-functional movement (18 year's benefit) or non-functional increments (10/20 years of service) and other issues:
(i) The Finance Department, Government of West Bengal in its Memorandum no. 2728-F dated 7th April, 2009 (Para-2) has clarified the matter as following
1. In the case of non-functional movement (18 year's benefit) or non-functional increment (10/20 year's benefit) an employee may opt for the same on the date of entitlement or on the next 1st July, the date of accrual of annual increment.
2. In case the employee opts for the benefit on the date of entitlement he/she will get one increment on the date, but he/she will not be entitled to next annual increment on the next 1st July unless he/she completes 6 months of service. In other words- if the date of entitlement falls during 1st July to 1st January, the employee after having the benefit of one additional increment, on the date of entitlement, will get annual increment on the next 1st July, but if the date of entitlement falls during 2nd January to 30th June, the employee after having the benefit of one additional increment, will not be entitled to the annual increment on 1st July of the same year; he/ she will, however, get the annual increment on the 1st July of the next year.
3. In case the employee opts for the benefit on the date of accrual of annual increment, on 1st July he/she will get the annual increment first and then he/she will get the additional increment for non-functional benefit on the basic pay arrived at after getting the annual increment.
4. In case of 18 year's benefit the admissible Grade Pay will be allowed as per Para-1 above from the date he/she opts for the benefit.
(ii) In case of Extra Ordinary Leave (EOL) availed by an employee not for medical grounds the benefit of 18 years of continuous service and /or 10/20 years of continuous service (as the case may be) may be granted if the total period excluding the period of Extra Ordinary Leave (EOL) is not less than 18 years and/or 10/20 years (as the case may be) and the non-service period for Extra Ordinary Leave (EOL) is duly condoned by appropriate authority prescribed in this regard.
ROPA 2019 অনুযায়ী, একজন শিক্ষক-শিক্ষিকার 18 year's Service সম্পন্ন হলে তার কেবলমাত্র Level-টি পরিবর্তন হবে। যেমন Level-9 থেকে Level-10 তে যাবে অথবা Level-11 থেকে Level-12 তে বৃদ্ধি পাবে কিন্তু Cell Number এর কোনো পরিবর্তন হবে না । কোন কোন ক্ষেত্রে Cell Number কমে যেতেও পারে ।
অতএব, 18 years benefit-এর সময় Level পরিবর্তন হবে, আর Annual Increment-এর সময় Cell Number পরিবর্তন হবে, Level পরিবর্তন হবে না। যেমন Cell Number-11 Annual Increment-এর পর Cell Number-12 তে অথবা Cell Number-9 থেকে Cell Number-10 এ প্রবেশ করবে।
মনে রাখবেন, ROPA 2019 অনুযায়ী 18 years benefit-এর সময় Annual Increment-এর সাথে সম্পর্ক 'Cell Number'-এর এবং Additional increment (for 18 years benefit ) এর সঙ্গে সম্পর্ক 'Level' এর।
উদাহরণ : মাধ্যমিক বিদ্যালয় বা উচ্চ-প্রাথমিক বিদ্যলয়ের একজন Pass Graduate Course এর শিক্ষক-শিক্ষিকার 18 year's Service সম্পন্ন হলে, তার Level-11, Cell Number-20 (Grade Pay Rs 4100/-) থেকে Level-12, Cell Number-18 (Grade Pay Rs 4400/-) তে পৌঁছবে। এক্ষেত্রে Cell Number পরিবর্তন হবে না বরং Cell Number কমে যেতে পারে।
একজন প্রাথমিক বিদ্যলয়ের শিক্ষক-শিক্ষিকার 18 year's Service পূর্ণ হলে তার Level-9, Cell Number-14 (Grade Pay Rs 3600/-) থেকে Level-10, Cell Number-11 (Grade Pay Rs 3900/-) তে ঢুকবে, শুধুমাত্র Cell Number কমে যাবে।
চাকুরীতে যোগদানের তারিখ 1st July থেকে 1st January (মানে-July, August, September, October, November, December এবং January মাসের 1 তারিখ পর্যন্ত ) মধ্যে হলে Annual Increment সুবিধা পাবেন 1st July থেকে, vide GO No. 181-SE(B)/5B-1/09 dated 08.10.2009 ( নিম্নে Memorandum টি দেওয়া হলো ) তারপর তার নিজের Joining Date থেকে 18 years benefit পাবেন।
মনে রাখতে হবে Annual Increment সুবিধা প্রথমে নিতে হবে তার পর 18 years benefit, কারণ একটা Increment পাওয়ার পর নূন্যতম 6 (six months) মাস পর অন্য্ কোনো Increment এর সুবিধা পাবেন অর্থাৎ দুটো Increment এর মাঝে Minimum 6 (six months) মাসের ব্যবধান থাকতেই হবে।
উদাহরণ: ধারা যাক, কোনো শিক্ষক-শিক্ষিকার Joining Date হয় 14.09.2002, তাহলে তার Annual Increment হবে 1st July, 2020 তে, 18-Years পূর্ণ হচ্ছে 13.09.2020 এবং 18-Years benefit এর সুবিধা পাবেন 14.09.2020 থেকে।

01.07.2020 তারিখে তার Annual Increment হবে এবং তার পর Basic Pay Rs 56900/- (Level-11, Cell Number-19)
14.09.2020 (তার Joining Date) তারিখে তার 18 years benefit লাগু হবে Basic Pay Rs 58600/- (Level-11, Cell Number-20) এখানে উনার Level পরিবর্তন হবে। এখন তিনি Level-12 (Grade Pay Rs 4400/-) তে যাবেন, এখন তার Basic Pay Rs 59100- (Level-12, Cell Number-18 এবং Grade Pay Rs 4400/-) হবে।
চাকুরীতে যোগদানের তারিখ 2nd January থেকে 30th June (মানে-2nd January থেকে, February, March, April, May, এবং June মাস পর্যন্ত ) মধ্যে হলে Annual Increment এবং 18 years benefit উভয়ই 1st July থেকে লাগু হবে।
মনে রাখতে হবে 18 years benefit আগে নিলে Annual Increment সেই বছর আর পাবেন না, কারণ একটা Increment পাওয়ার পর নূন্যতম 6 (six months) মাস পর অন্য্ কোনো Increment এর সুবিধা লাগু হয় অর্থাৎ দুটো Increment এর মাঝে Minimum 6 (six months) মাসের ব্যবধান থাকতেই হবে।
উদাহরণ: ধারা যাক, কোনো শিক্ষক-শিক্ষিকার Joining Date হয় 08.05.2002, তাহলে তার Annual Increment এবং হবে 1st July, 2020 তে, 18 years পূর্ণ হচ্ছে 07.05.2020 এবং 18 years benefit এর সুবিধা পাবেন 08.05.2020 থেকে। এক্ষেত্রে 18 years benefit দুই মাস পিছিয়ে যাবে এবং উভয়ই (Annual Increment এবং 18 years benefit) 1st July, 2020 থেকে কার্যকর হবে।কিন্তু যদি কেউ উল্টোটা করেন, মানে 18 years benefit আগে নেন তাহলে সেই বছর আর Annual Increment পাবেন না।

একটা উদাহরণ দিয়ে বোঝানো হলো-
Sri Bimal Mondal Assistant Teacher of Ramipur Primary School under Raninagar-I Circle of Murshidabad DPSC has completed 18 years continuous and satisfactory service from the date of 1st Appointment ie 21.02.2002 to 20.02.2020 without any single promotion and advancement to a higher scale. In terms of rules 437-SE(P&B)/SL/5S-408/19 Dated 13.12.2019. He is allowed under 18 years Benefit from the date of next Annual increment on 01.07.2020 as per his option.
His pay is hereby fixed in the next higher Level in the following manner:
1. Date of 1st Appointment and Joining : 21.02.2002
2. Date of Completion of 18 years Service : 20.02.2020
3. Date of effect of 18 years benefit (as per Option) : 01.07.2020
4. Existing Pay Band Scale : PB-3 Rs. 7,100-37,600/- Basic Pay in the Level 9 : Rs. 38,800/- (Cell No.11) in the Pay Matrix as per ROPA-2019.
